Welcome to Postbadger. These Terms of Use ("Terms") govern your access to and use of the Postbadger website at www.postbadger.app and the Postbadger browser extension (collectively, the "Service"). The Service is operated by Michał Włosik EFC, a sole proprietorship registered in Poland. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Postbadger is a browser extension and web application that enables users to download, organize, and export posts from X.com (formerly Twitter) profiles. The Service includes features such as date filtering, post limit controls, multiple export formats (CSV, JSON, Markdown, HTML, Excel), and a built-in editor for viewing and managing downloaded content.

2. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into a binding agreement.

3. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account

You are solely responsible for safeguarding your password and for any activities or actions under your account. Postbadger will not be liable for any loss or damage arising from your failure to comply with this security obligation.

4. Subscription Plans and Payments

Postbadger offers various subscription tiers with different usage limits:

• Free Plan: Limited to 100 posts per month
• Pro Plan: Up to 20,000 posts per month
• Business Plan: Up to 100,000 posts per month

Paid subscriptions are billed on a recurring basis (monthly or annually, as selected). All fees are non-refundable except as expressly set forth in these Terms or as required by applicable law. We reserve the right to modify pricing with reasonable notice to subscribers.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
• Use the Service to infringe upon the intellectual property rights of any third party
• Use the Service to harass, abuse, stalk, threaten, or otherwise violate the rights of others
• Attempt to circumvent any usage limits, security measures, or access restrictions
• Use the Service to collect or harvest personal data for unauthorized purposes
• Use the Service in any manner that could disable, overburden, damage, or impair the Service
• Resell, redistribute, or sublicense the Service or any data obtained through it without authorization

6. Third-Party Platforms

The Service interacts with X.com (formerly Twitter), a third-party platform. Your use of the Service must comply with X.com's Terms of Service and all applicable platform rules. Postbadger is not affiliated with, endorsed by, or sponsored by X Corp. or any of its affiliates. We are not responsible for any changes to third-party platforms that may affect the functionality of our Service.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Michał Włosik EFC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

Content downloaded through the Service remains the intellectual property of its respective owners. You are solely responsible for ensuring your use of downloaded content complies with applicable copyright laws and the rights of content creators.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy. Downloaded content is stored locally on your device; Postbadger does not retain copies of downloaded posts on its servers.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Michał Włosik EFC, its owners, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us, if any, during the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Michał Włosik EFC and its owner, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the common courts of Poland competent for the registered seat of Michał Włosik EFC in Wrocław.

15. Consumer Rights

If you are a consumer within the meaning of applicable law, nothing in these Terms shall affect your statutory rights that cannot be waived or limited by contract. In particular, consumers residing in the European Union retain all rights granted under applicable EU consumer protection legislation.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Michał Włosik EFC regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements between you and Michał Włosik EFC.
